PCT, Partnership And Employment Dispute Cover
New from MIAB, Professional fees policy specifically designed for GP practices.
It offers two unique covers, firstly protection against Health Service Contract disputes with a PCT and secondly protection against Partnership Disputes between partners. In addition the policy also offers protection against Employment Disputes and Awards in an Employment Tribunal.
The policy also has the advantage of offering nationally recognised lawyers who specialise in the GP marketplace, which is obviously important when dealing with either Health Service or Partnership disputes.

Health Service Contract Dispute - Unique to MIAB
Professional Fees incurred by You:
1. in defending an action following an alleged specific breach of the terms contained within a contract for the provision of healthcare or medical services under the following (as may respectively be amended from time to time)
a. The National Health Service (Personal Medical Services Agreements) Regulations 2004,
b. The National Health Service (General Medical Services Contracts) Regulations 2004,
c. The National Health Service (Alternative Provider Medical Services) Directions 2009,
2. in respect of proceedings for the suspension or removal of Your name from:
a. The National Health Service (Performers Lists) Regulations 2004 (as may be amended from time to time)
and which four sets of regulations are for the purposes of this Section 9 collectively referred to as “the Regulations” and which could, in accordance with the Regulations, result in termination of the relevant contract.
This cover applies whether or not you have elected to operate under Health Service Body status.
The Regulations apply to events arising in England but this cover applies also in Wales and Northern Ireland subject to the provisions of comparable Regulations in each of these two countries as if the same were substituted for the above Regulations as the case may be.
Employment
Legal representation in employment disputes and in Employment Tribunals: the insurance also covers the cost of any compensation or award, should the Tribunal find against the practice.
Partnership Disputes – Unique to MIAB
Professional Fees incurred by the Policyholder in defending orpursuing an allegation against a fellow partner or partners following any breach of the terms contained within a partnership agreement and/or the general law, including advising on the procedure prior to an expulsion and on the operation of any terms of an agreed partnership agreement conferring the right to expel, where the allegation concerns either a breach of the agreement and/or the Act and/or the general law which is materially affecting the operation of the partnership and/or allegations which could result, or has resulted, in the termination of the partnership and/or the voluntary or involuntary expulsion of one or more partners there from. Professional Fees incurred by the Policyholder in defending or pursuing an allegation against a fellow partner or partners following any breach of the general law and/or the provisions of the Partnership Act 1890 (as amended from time to time) where the allegation concerns a breach which is materially affecting the operation of the partnership and/or allegations which could result in the dissolution of the partnership.
